Slip and Fall Claims

What can affect a claim?

Injuries and losses are only part of the picture. Whether another party had a legal duty, what they knew or should have known about a hazard, and whether the hazard caused the injury may matter. Rules vary with the jurisdiction and circumstances; an injury on someone else's property does not automatically establish liability.

Evidence to preserve

Photographs, witness contacts, incident reports, medical records, and maintenance or video records may help establish what happened. Ask a lawyer promptly about preserving evidence that another party controls. Keep records of costs and lost earnings.

Fault and settlement

The parties may dispute whether the injured person's actions contributed to the fall. The legal effect of shared fault varies and can reduce or bar recovery. A settlement, if reached, depends on the evidence, coverage and applicable law; there is no reliable payout based only on injury type.
